I had 4yrs and 4 months of H1B stint here in the US. After this, I converted to F1 for a full-time masters. Currently, I am working with a top-bank (TARP recipient) on OPT status. I would like to know my options so that I can plan accordingly. I am listing down my questions. Your help is MUCH appreciated. 1) My employer haven't initiated my OPT to H1 transfer yet (they said they are willing to do it though. HR manager says there is no issues with TARP regulations on two counts - a) I have a masters from US b) I was hired before the bank took TARP). My OPT expires on 07/14. I am still following up with super-red-tape HR. Is there a timing issue that I need to be aware of? Will there be a difference in processing time for cap-counted candidates like me? 2) Since I already had a H1, can/should I go back to my employer and discuss about cap-gap options? What kind of options do I have? My employer does not seem to understand immigration issues. 3) I am in the state of Georgia. Georgia's driver's license is valid until via expiry - which is 07/14. I must have a driver's license - we have a 15-month old. If I had to fall on cap-gap, is there way I can handle driver's license issues? Please advice. Thank you very much!
